Terms & licensing
Terms for using this website, and a plain summary of how the software is licensed.
1. These terms
This website is operated by NexaTech Consulting (PTY) LTD, registration number 20231968737, of 17 Dock Road, Watershed, Cape Town, Western Cape, South Africa, 8002 ("we", "us"). By using the site you accept the terms on this page.
2. The content here is informational
Product descriptions on this site are provided for information. They are not a specification, a warranty or an offer capable of acceptance, and they do not form part of any contract between us. Where a feature is described, the authoritative statement of what a given release does is the documentation shipped with that release.
We update these pages as the products change, and we may change or withdraw content at any time without notice.
3. No warranty for the website
The site is provided "as is". We do not warrant that it will be uninterrupted or error-free, and to the fullest extent permitted by law we exclude liability for any loss arising from reliance on its content. Nothing in these terms limits liability that cannot lawfully be limited.
4. Intellectual property
The content, design and code of this site are owned by us or our licensors and are protected by copyright. You may view it, and quote reasonable extracts with attribution, but you may not reproduce the site or substantial parts of it as your own.
"EasyAccess" and "NexaTECH", together with the associated logos, are marks of NexaTech Consulting (PTY) LTD. Other product and company names mentioned on this site are the marks of their respective owners, used descriptively and without any claim of affiliation or endorsement.
5. How the software is licensed
The EasyAccess products are proprietary software. They are licensed, not sold, and are deployed by you in your own infrastructure. The summary below is for orientation only — the licence agreement accompanying the software governs, and we will provide the full text on request before you commit to anything.
- Self-hosted. You run the software. We do not operate any part of the data path and do not require connectivity to us for the product to function.
- Term licences. Licences are issued for one, three or five years. Perpetual licences are not offered, and a licence without an expiry is rejected by the software.
- Bound and signed. Licences are cryptographically signed and bound to the deployment, and the software audits licence validity across cluster nodes.
- Tiers. Trial, Standard, Enterprise and Unlimited tiers differ in the features enabled and the number of concurrent sessions permitted.
- Evaluation. A trial licence covering three concurrent sessions and all features is available for evaluation purposes.
- Service provision to third parties. Using the software to provide a service to parties outside your organisation (service bureau or managed service arrangements) requires a separate written agreement.
- Marketplace. Where the software is listed on a cloud marketplace, the listing covers deployment of the software into your own account. Infrastructure is charged by the cloud provider; the licence is acquired from us.
6. Third-party components
The products incorporate open source components under their own licences. A software bill of materials and the corresponding third-party notices are generated from the build and distributed with the software, so you can see exactly what is included in the release you are running.
7. Compliance claims
Where this site states that product controls are mapped to a framework such as PCI DSS, ISO 27001, SOC 2, NIST SP 800-53 or SWIFT CSP, that means the controls have been implemented and documented against that framework. It does not mean that we or the product hold a certification under it. Current certification status is stated explicitly on the relevant product page and will be confirmed in writing during any procurement process.
8. Export and lawful use
Our software is subject to applicable export control and sanctions laws. You may not acquire or use it in breach of those laws, and you are responsible for ensuring that your use complies with the law in your jurisdiction.
9. Governing law
These website terms are governed by the law of the Republic of South Africa, and the courts of Cape Town have jurisdiction. Licence agreements for the software state their own governing law and jurisdiction, which may differ by agreement.
